1. Acceptance of Terms

By downloading, installing, or using the IngreIQ mobile application (“App”) or visiting our website at ingreiq.com (“Website”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the App or Website.

These Terms constitute a legally binding agreement between you and IngreIQ (“we,” “us,” or “our”). By accessing or using our services, you confirm that you have read, understood, and agree to be bound by these Terms.

2. Description of Service

IngreIQ is a personalised ingredient health intelligence platform. The App scans food and consumer product barcodes and analyses ingredient lists in relation to a user’s self-reported health profile, including conditions, allergens, and dietary preferences.

IngreIQ is NOT a medical device. It is NOT a substitute for professional medical advice. It is NOT a clinical diagnostic tool. The App is designed to help you understand ingredient compositions and their general relationship to publicly available health guidance — nothing more.

3. Eligibility and Account Registration

Age requirement (COPPA compliance): This App is intended for users aged 13 and over. By using this App, you confirm that you are at least 13 years of age. Family profiles for children may only be created and managed by a parent or legal guardian aged 18 or over. IngreIQ does not knowingly collect personal information from children under 13 without verifiable parental consent. If you are a parent or guardian and believe your child under 13 has provided us with personal information without your consent, please contact us at privacy@ingreiq.com.

When creating an account, you agree to provide accurate and complete information and to keep it updated. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.

4. Health Information Disclaimer

The information provided by IngreIQ is for general informational purposes only and is not intended as, and shall not be understood or construed as, professional medical advice, diagnosis, or treatment. Always seek the advice of your physician, pharmacist, or other qualified health provider with any questions you may have regarding a medical condition, dietary restriction, or medication interaction. Never disregard professional medical advice or delay in seeking it because of something you have read or seen in this App.

5. AI Content Disclaimer

Health information provided through our AI features is generated by artificial intelligence and has not been reviewed by a licensed healthcare professional. AI-generated content may contain errors, omissions, or outdated information. You should not rely solely on AI-generated health information when making decisions about your diet, health, or medications.

All AI-generated responses are accompanied by a disclaimer in the App interface. This disclaimer is non-removable and is a required part of every AI response.

6. Third-Party Data Disclaimer

Product information, including ingredients, nutritional data, allergen information, and additive classifications, is sourced from third-party databases including Open Food Facts and the USDA FoodData Central database. IngreIQ does not guarantee the accuracy, completeness, or currency of this information. Always verify ingredient and allergen information on the actual product packaging before consuming, particularly if you have a serious allergy or medical condition.

7. Additive Information Disclaimer

Additive risk classifications are based on published scientific literature and regulatory guidance as of the time of our last database update. The presence of a flagged additive does not mean a product is unsafe for consumption. Risk levels reflect population-level evidence and may not apply to your individual circumstances.

Each additive flag in the App displays an evidence grade (“Established,” “Probable,” or “Possible”) derived from major regulatory bodies including the International Agency for Research on Cancer (IARC), the US Food and Drug Administration (FDA), and the European Food Safety Authority (EFSA).

8. Premium Subscriptions

Certain features of the App require a paid subscription (“Premium”). Current pricing is displayed in the App at the time of purchase. Subscriptions are available on a monthly or annual basis at rates shown at checkout.

Free trial: New subscribers receive a 7-day free trial. You will not be charged during the trial period. If you do not cancel before the trial ends, your subscription will automatically convert to a paid subscription at the rate shown at the time of sign-up.

Auto-renewal: Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period. You may cancel your subscription at any time through your App Store or Google Play account settings, or through the IngreIQ app.

Refunds: Subscription payments are generally non-refundable. Refund requests may be submitted to Apple (iOS) or Google (Android) according to their respective refund policies.

9. User-Generated Content

By submitting product information, reviews, or corrections to our database, you grant IngreIQ a non-exclusive, royalty-free, worldwide licence to use, modify, reproduce, and distribute that content. You confirm that your submissions are accurate to the best of your knowledge and do not infringe the rights of any third party.

10. Intellectual Property

The App, Website, and all content, features, and functionality — including but not limited to the ingredient scoring algorithm, personalisation engine, additive risk database, and system prompts — are owned by IngreIQ and are protected by copyright, trade secret, and other intellectual property laws.

You may not copy, modify, distribute, sell, or lease any part of our services or included software. You may not reverse-engineer or attempt to extract our source code, algorithms, or database contents unless applicable law prohibits this restriction.

11. Acceptable Use

You agree not to use the App to:

  • Provide false health or personal information
  • Attempt to scrape, reverse-engineer, or extract data from the App at scale
  • Use the App for any unlawful purpose or in violation of any applicable regulations
  • Attempt to gain unauthorised access to any part of our systems
  • Use the App to make clinical or medical decisions without consulting a qualified health professional

12. Limitation of Liability

To the maximum extent permitted by applicable law, IngreIQ and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of health, personal injury, or allergic reactions resulting from reliance on information provided through the App.

Our total cumulative liability to you for any claim arising out of or relating to these Terms or the App shall not exceed the amount you paid us in the twelve months preceding the claim, or $100 USD, whichever is greater.

13. Indemnification

You agree to indemnify and hold harmless IngreIQ, its affiliates, officers, directors, employees, and agents from any claims, losses, damages, liabilities, and expenses (including reasonable legal fees) arising from your use of the App, your violation of these Terms, or your violation of any rights of another person or entity.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any legal proceedings arising from these Terms that are not subject to arbitration shall be brought exclusively in the state or federal courts located in Delaware.

15. Dispute Resolution and Arbitration

Any dispute arising out of or relating to these Terms or the use of IngreIQ shall be resolved by binding individual arbitration under the rules of the American Arbitration Association, rather than in court. You waive your right to participate in a class action lawsuit or class-wide arbitration.

Note: Class action waiver enforceability varies by jurisdiction. This clause is under review by qualified US legal counsel.

Before initiating arbitration, you agree to first contact us at support@ingreiq.com and attempt to resolve the dispute informally for at least 30 days.

16. Changes to These Terms

We may update these Terms from time to time to reflect changes in our services, legal requirements, or business practices. We will notify you of material changes by posting a notice in the App at least 14 days before changes take effect. Continued use of the App after changes take effect constitutes your acceptance of the revised Terms.

17. Termination

We reserve the right to suspend or terminate your account at any time if you violate these Terms, engage in conduct harmful to other users, or for any other reason at our sole discretion, with or without notice. You may delete your account at any time from the App Settings. Upon termination, your right to use the App ceases immediately.

18. General Provisions

Severability: If any provision of these Terms is found to be unenforceable, that provision will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will remain in full force.

Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and IngreIQ regarding the App and supersede all prior agreements.
